This is a binding legal Agreement between you and PhotoQuery, Inc. ("PhotoQuery"). By using this site, or otherwise taking possession of any photographs or images of any kind through PhotoQuery.com, you acknowledge that you have read this Agreement and agree to its terms.

The contents of this website are protected by United States copyright and other laws, and any use of this website beyond the scope of the license(s) granted herein is strictly prohibited.

Limited Royalty-Free Non-Exclusive Viewing License, Including Comps

PhotoQuery grants you a free, non-transferrable, non-exclusive right to view PhotoQuery.com pages, to copy images from the site onto your hard drive, and to use those images to produce comprehensive layouts ("comps"), storyboards, rough draft designs, and in-house presentations for your clients, provided and on the express condition that you comply with all terms of this Agreement and all other terms set forth by or for PhotoQuery during your use of this site or its contents. You agree not to make any additional use of PhotoQuery.com images or other material absent a prior, signed, written agreement with PhotoQuery.

Royalty-Bearing Licenses

Unacceptable Use

Photographs and other material available through PhotoQuery.com may not be used in any negative or defamatory manner, resold or redistributed in any manner or added to archives, databases, or placed online for others to download, or used in any situation which implies an endorsement of any product or service.

Releases

Unless PhotoQuery indicates that a release exists for an image (such as a model or property release), you agree not to take any action for which such a release might be required. PhotoQuery gives no warranty with respect to the use of any images, names, trademarks, logos, copyrighted designs, or art displayed in any photograph, and you assume sole responsibility for securing any necessary rights and permissions. Furthermore, you indemnify PhotoQuery.com for any claim brought against it based on any use by you or for you of images or other content from PhotoQuery and/or this website.

Limitation of Liability; Jurisdiction and Venue

Under no circumstances will PhotoQuery, its owners, officers, agents or employees be liable for any damages whatsoever, including, but not limited to, damages for loss of business profits, business interruption, or data loss arising directly or indirectly by supplied media or photograph(s), by the use or inability to use the images, or by the inability to obtain additional rights to the photograph(s). In any event and under any circumstances, PhotoQuery's maximum aggregate liability to you shall not exceed the amount paid by you to PhotoQuery. You agree that the only entity against which you can make any claim of any kind in connection with the PhotoQuery.com site or its contents is against PhotoQuery, Inc. You agree to submit to the personal jurisdiction in the state of Oregon, and you agree that Oregon shall be the sole venue for any litigation or other dispute between you (or on your behalf) and PhotoQuery or any of its owners, officers, agents or employees, that relates in any way to this site or its contents, including any act or omission of any kind.

All photographs are provided "as-is". PhotoQuery makes no warranty, express or implied, of merchantability, fitness for any particular use, type of quality or image, or compatibility with any computer or equipment. The entire risk as to results, performance, and appearance of the photograph(s) is assumed by you.

Entire Agreement

This Agreement is the entire agreement between you and PhotoQuery, and supersedes any other communications, representations or agreements of any kind with respect to the subject matter hereof. No terms or conditions may be added, deleted, or modified unless made in writing and signed by the purchaser and PhotoQuery. If any provision of this Agreement is found to be invalid, the remainder shall continue in full force.
